.Ember

These Terms of Use (“Terms”) apply to .Ember (DotEmber). They supplement — and do not replace — the NilToDev master Terms of Use and the Apple Media Services Terms (the “App Store EULA”). Both apply to your installation and use of .Ember.

Where these app-specific Terms add to the master, both apply. Where they clarify a topic the master leaves open, the more specific text (these Terms) governs.

1. Acceptance

Downloading, installing, or starting a Free Trial of .Ember from the Mac App Store constitutes acceptance of these Terms, the NilToDev master Terms, and the App Store EULA.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use .Ember in accordance with the App Store EULA. This license supplements §1 of the NilToDev master Terms.

3. Permitted use

• Family Sharing. You may share your purchase via Apple Family Sharing per Apple’s standard rules.
• Multiple Macs. You may install .Ember on any Mac signed in to the same Apple ID that holds the purchase.
• Personal and internal business use is permitted. Redistribution outside the App Store mechanism is not.

4. Restrictions

You agree not to:

• Reverse-engineer, decompile, or attempt to derive source code from .Ember, except to the extent applicable law expressly permits.
• Remove, obscure, or alter copyright, trademark, or other proprietary notices that appear in the app.
• Sublicense, resell, or distribute the app outside the App Store mechanisms (such as Family Sharing).
• Circumvent the Free Trial mechanism or any license-validation logic.

5. Your content

.Ember is local-first. Your vault — journal entries, todos, calendar blocks, timer sessions, and settings — is yours. We never see it; we have no copy of it. You retain all rights to your content. See the .Ember Privacy Policy for the full data flow and storage details.

6. Third-party services

.Ember offers optional integrations: iCloud Sync (Apple CloudKit), Google Calendar + Tasks, Apple Calendar (EventKit), RSS / News feeds, and BYOK AI (Anthropic / Google / OpenAI). When you enable an integration:

• You provide the account or API key for that service.
• The third-party service’s own terms and privacy policy apply to data exchanged with it.
• We are not responsible for outages, charges, data loss, or data-handling decisions at the third-party service.

You are responsible for staying within any usage limits, fees, or acceptable-use rules that the third-party service imposes on your account.

7. AI output disclaimer

.Ember’s AI features (Auto-arrange Inbox, Daily Brief, palette commands) generate output by sending feature-specific data to the AI provider you have configured. AI output is provided for convenience and may be incorrect, outdated, or misleading. Do not rely on .Ember’s AI output as medical, legal, financial, or other professional advice. Verify before acting on it.

8. Pricing and Free Trial

.Ember offers a free trial period of [TBD: Free Trial duration] before requiring a one-time in-app purchase to continue using the app. The trial is implemented within the app and uses Apple’s StoreKit framework where applicable. The trial is governed by the App Store EULA in addition to these Terms.

The price displayed on the App Store at the time of purchase is the applicable price. We may change pricing prospectively for new purchases. Existing one-time purchases remain entitled to the features of the version they purchased, under the App Store EULA.

9. Purchase, license, and refunds

Purchases are processed by Apple under the App Store EULA. We do not directly receive your payment information (credit-card details, billing address, etc.). Refund requests are handled by Apple at reportaproblem.apple.com. NilToDev cannot process direct refunds.

For users in the Republic of Korea: the digital-content withdrawal-right framework under the Act on Consumer Protection in Electronic Commerce (전자상거래법, Article 17) may be exercised through the Apple refund procedure linked above. Apple administers the refund mechanism for purchases made through the Mac App Store.

10. Updates and continuity

.Ember updates are delivered via the Mac App Store and are subject to your Mac’s update preferences. We may add, modify, or remove features in future updates. We make no warranty that any specific feature will remain available indefinitely. Material removals will be noted in the in-app changelog and on /dotember/changelog.

11. Termination

You may stop using .Ember at any time and delete it from your Mac. Material breach of these Terms or of the App Store EULA may result in license termination. Sections 4, 5, 7, 12, and 13 survive termination.

12. Disclaimer of warranties

.Ember is provided “as is” and “as available.” This supplements §6 of the NilToDev master Terms without modifying its scope. We make no warranty that the app will be error-free, uninterrupted, or compatible with any specific macOS version other than those officially supported in the App Store listing.

13. Limitation of liability

The limitation of liability in §7 of the NilToDev master Terms applies to your use of .Ember without modification.

14. Governing law and dispute resolution

This addendum does not establish a separate governing law or dispute resolution forum. The App Store EULA’s governing-law provisions apply to your purchase and use of .Ember on the Mac App Store. The NilToDev master Terms govern any matters not covered by the App Store EULA.

15. Changes

Material changes to these Terms will be reflected in the Last updated line at the top of this page. Continued use of .Ember after a change constitutes acceptance of the revised Terms. The version-controlled source of this addendum lives at docs/privacy/terms-of-service.en.md in the .Ember repository; the canonical published copy is this page on niltodev.com.
